Welcome to Wan Animate, an AI-powered image generation platform that harnesses Google Gemini 2.5 Flash technology through nano banana AI to provide advanced text-to-image, image editing, and multi-image fusion capabilities. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

Wan Animate provides users with AI-powered image generation services including:

• Text-to-Image Generation: Create images from text descriptions
• Image Editing: Modify existing images with AI-powered instructions
• Multi-Image Fusion: Combine multiple images into a single composition

You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations. All generated content includes invisible watermarks (SynthID) for content authenticity purposes.

User Accounts and Registration

1. Account Creation: To access the AI image generation features, you must create an account using Google OAuth authentication. You must provide accurate information during the registration process.

2. Account Security: You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any security breaches.

Credits and Usage Policy

Wan Animate operates on a credit-based system:

• Free Tier: Each user receives one (1) lifetime free generation credit upon account creation
• Usage Tracking: We track your credit usage to ensure fair access to our services
• Credit Consumption: Each successful generation (text-to-image, image editing, or multi-image fusion) consumes one credit
• Failed Generations: Credits are automatically refunded if generation fails due to technical issues
• Rate Limits: Users are limited to 3 generation attempts per minute to ensure service quality

Content and Intellectual Property Rights

Your Content

• Generated Images: You retain ownership rights to the images you generate using our service
• Input Content: You retain ownership of any images or text prompts you provide as input
• Commercial Use: You may use generated images for commercial purposes, subject to these terms

Our Platform

• Service Technology: The underlying AI models, platform technology, and service infrastructure remain our property
• SynthID Watermarks: All generated images contain invisible SynthID watermarks that cannot be removed
• Attribution: While not required, we appreciate attribution when sharing generated content publicly

Third-Party Rights

• You must ensure that any content you upload or prompts you submit do not infringe on third-party intellectual property rights
• We are not responsible for copyright infringement claims arising from your use of the service

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using Wan Animate:

Content Restrictions

• Generating images containing hate speech, violence, explicit sexual content, or illegal activities
• Creating content that infringes on third-party copyrights, trademarks, or other intellectual property
• Generating images intended to harass, threaten, or harm individuals or groups
• Creating deepfakes or misleading content involving real people without consent

Technical Restrictions

• Attempting to reverse engineer, circumvent, or disable the SynthID watermarking system
• Using automated tools, bots, or scripts to generate content at scale
• Attempting to bypass rate limits or credit restrictions
• Interfering with or disrupting the security or performance of the service

Platform Misuse

• Sharing account credentials or attempting to create multiple accounts to obtain additional free credits
• Using the service for any illegal or unauthorized purpose
• Violating any applicable local, national, or international laws

Privacy and Data Collection

Wan Animate collects and processes data as detailed in our Privacy Policy, including:

• Account Information: Information from your Google OAuth authentication
• Generated Content: AI-generated images, prompts, and metadata (stored for 60 days)
• Usage Details: Generation history, feature usage, and service interactions
• Device Information: Browser type, IP address, and device characteristics
• Payment Information: Billing details for premium features (if applicable)

Pricing and Payments

Free Service

• Each user receives one (1) lifetime free generation credit
• No payment information required for free tier usage

Refund Policy

• Refund requests must be submitted within 7 days of purchase
• Only eligible if less than 5% of purchased credits have been used
• Processing time: 2-3 business days for review, 5-7 business days for refund
• All refunds are processed back to the original payment method

General Payment Terms

• Prices are subject to change with advance notice
• All transactions are processed securely through Stripe
• You agree to pay all charges associated with your usage

Termination

We may terminate or suspend your account and access to the service under the following circumstances:

• Violation of Terms: Any breach of these Terms of Service or our usage policies
• Prohibited Content: Repeated generation of prohibited or harmful content
• Technical Abuse: Attempts to circumvent security measures, rate limits, or credit systems
• Legal Compliance: As required by law or legal process

Upon termination, your access to the service will be immediately revoked, and any remaining credits will be forfeited. Generated images may be deleted according to our standard retention policy.

Disclaimer of Warranties

Wan Animate is provided on an "as is" and "as available" basis. We make no warranties regarding:

• Service Availability: Continuous, uninterrupted, or error-free operation
• Content Quality: The accuracy, quality, or suitability of generated images
• AI Model Performance: Results may vary and are not guaranteed to meet expectations
• Data Security: While we implement security measures, we cannot guarantee absolute security

We disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Wan Animate shall not be liable for:

• Direct Damages: Any damages directly resulting from service use or inability to use
• Indirect Damages: Lost profits, business interruption, or consequential damages
• Content Issues: Problems arising from generated images or user-provided content
• Third-Party Services: Issues with integrated services (Kie.ai, Google, Stripe, Cloudflare)

Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Wan Animate and its service providers from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the service or violation of these Terms
• Content you generate, upload, or share through the service
• Your violation of any third-party rights or applicable laws
• Any disputes between you and other users of the service

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the service shall be resolved through:

1. Informal Resolution: Good faith negotiations between the parties
2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
3. Governing Jurisdiction: Subject to the laws of the jurisdiction where Wan Animate operates
